What is mediation? It is an alternative to litigation whereby the parties to a dispute agree to sit down with a third party neutral to engage in conversations/negotiations to resolve their dispute. The third party neutral, known as the mediator, facilitates these conversations between the parties. Mediation is fast becoming the preferred forum for dispute resolution, especially in divorce cases and non divorce cases involving children.
Mediation is a process of self determination where the parties actively participate in shaping, creative agreements. These agreements can be outside of the scope of those that a Court could order. There in lies the beauty of mediation- creativity, and innovation in crafting an agreement that works in each case with its own set of unique intricacies. When parties actively participate in crafting their own agreement they are more likely to abide by its terms instead of having terms dictated to them by a Court that utilizes a cookie cutter set of rules and regulations for every case presented to it.
We offer mediation services in divorce and family cases as well as business disputes and litigation cases. With a keen eye towards identifying the underlying issues that are preventing the parties from reaching settlement, the Law Offices of Lorraine M.
